On "Living Constitutionalism"
Arguably, the ‘living constitutionalist’ (LC) approach to interpreting the U. S. Constitution is a form of eisegesis, according to which the reader imposes his own biases onto the text, using it as a tool to support his priorly held commitments. This method is generally viewed as bad form with respect to the interpretation of literary, philosophical, and religious texts. It seems to me that LC is also a defective method of reading the Constitution. For one thing, LC subjectivizes the document and enables a judge, via the mechanics of our legal institutions, to impose onto American society his own prejudices.
But some support LC — particularly those who believe that one of the primary roles of a judge is to engage in judicial activism.
